DSP Sync Terms of Use
Version 1.0 · Last updated November 5, 2026
These terms are the rules for using DSP Sync. Please read them. When you use DSP Sync, you agree to them. If you have a question, email us at legal@dspsync.app.
1. Who we are
DSP Sync is an app made by Earth Is Waking Up, LLC, an Oregon company. In these terms, "we" and "us" mean Earth Is Waking Up, LLC. "You" means the person who uses DSP Sync.
Care agencies use DSP Sync to run their work. If your agency has its own agreement with us, that agreement also applies to the agency. If it says something different from these terms, the agency agreement wins.
Our Privacy Policy explains how we handle information. You can read it at dspsync.app/privacy.
2. Who can use DSP Sync
- You must be 18 or older.
- An agency must invite you, or we must approve your account.
- Each account is for 1 person. Do not share your account.
3. Keeping your account safe
- Keep your password private.
- Use two-step sign-in when your agency turns it on.
- Sign out on shared devices.
- If you think someone else got into your account, tell your agency or email us right away.
4. Using DSP Sync the right way
Use DSP Sync only for your work with your agency, or to stay connected with your family member's care. Please:
- Look only at the information you need for your work or your family member's care.
- Enter information that is true and complete as far as you know.
- Treat everyone with respect.
- Keep what you see in DSP Sync private. Do not share screenshots or copies outside the care team.
Please do not:
- Try to get into accounts or information that are not yours.
- Try to break, overload, or copy DSP Sync, or get around its safety features.
- Use DSP Sync for anything illegal or harmful.
Nothing in these terms stops you from reporting suspected abuse or neglect, making a complaint to your agency or to a government agency, talking to your own lawyer, or doing anything else the law protects.
5. Not for emergencies
DSP Sync is not an emergency service. In an emergency, call 911 first. Messages and reminders in DSP Sync can be delayed or missed.
6. Your agency is in charge of care and billing
DSP Sync is a tool. It does not give medical, legal, or billing advice. Your agency makes the decisions about care, and it is responsible for what it sends to Medicaid or other payers. Please check the information before you send it.
7. Information in DSP Sync
Each agency owns the information that it and its people put into DSP Sync. We use that information only to run DSP Sync for the agency, as our agreement with the agency and the law allow.
If an agency stops using DSP Sync, it can get a copy of its information.
When an agency is covered by HIPAA (the federal health privacy law), we sign a Business Associate Agreement with it. That agreement controls how we handle the agency's health information.
8. Our app
We own DSP Sync, including its software, design, and name. While your account is open, you can use DSP Sync for the purposes in these terms. If you send us ideas or feedback, we can use them without owing you anything.
9. Emails and text messages
We send emails, texts, and notifications that DSP Sync needs to work, such as invitations, password reset codes, and reminders. Message and data rates may apply.
10. Other companies' services
Some features use services from other companies, such as maps. Their own terms also apply when you use those features.
11. Changes to DSP Sync and to these terms
We keep improving DSP Sync, so features can change. Each version of these terms has a number and a date. When we make an important change, we tell you before it takes effect. We may ask you to agree to the new version the next time you sign in. When you agree, DSP Sync keeps a record of the version you agreed to.
12. Pausing or closing an account
- You can stop using DSP Sync at any time.
- Your agency can turn off your access.
- We can pause or close an account to protect people or information, or if someone breaks these terms.
13. Our promises and their limits
We work hard to keep DSP Sync running, safe, and correct. But we cannot promise that it will always work without interruption or errors. DSP Sync is provided "as is," to the extent the law allows.
To the extent the law allows, we are not responsible for indirect losses, such as lost profits or lost data. Our total responsibility for any claim is limited to whichever is more: the amount your agency paid us for DSP Sync in the 12 months before the claim, or $100.
14. Oregon law
Oregon law governs these terms. Any dispute goes to the state or federal courts in Lane County, Oregon.
15. Help and accessibility
If you need help using DSP Sync or reading these terms, email support@dspsync.app. We will help you find a way that works for you.
